Thank you for visiting www.tri-loop.com (together with its content, subdomains, web interface, tools and services (“Website”), which is operated by Young Occupational Therapy Assessment and Intervention Products, L.L.C., d/b/a Tri-Loop and d/b/a YOTA-IP (“Company” or “Tri-Loop”). Your privacy is important to us. To better protect your privacy, Tri-Loop provides this privacy policy (“Privacy Policy”) explaining our online information practices and the choices you can make about the way your information is collected and used at the Tri-Loop Website. This Privacy Policy forms part of the Terms of Use, available at www.tri-loop.com/terms.

1. Introduction. Tri-Loop is committed to respecting your online privacy and recognizes your need for appropriate protection and management of any personally identifiable information (“Personal Information”) you share with us. “Personal Information” means any information that may be used, either alone or in combination with other information, to personally identify a business entity and/or individual, including, but not limited to, a first and last name, personal profile, a home or other physical address, an email address or other contact or billing information.

2. Consent and modification. By using the Tri-Loop Website, you consent to the terms of our general Terms of Use, including the terms of this Privacy Policy, and to Tri-Loop’s processing and use of Personal Information for the purposes set forth herein. If you do not agree to our general Terms of Use or Privacy Policy, you should not use the Tri-Loop Website. We reserve the right, at our discretion, to change this Privacy Policy at any time, which change will be effective immediately following posting the revised Privacy Policy on the Tri-Loop Website. Your continued use of the Tri-Loop Website following such posting means you accept such changes. We encourage you to review the Privacy Policy periodically to stay current with any updates. By submitting any Personal Information to Tri-Loop, making a purchase or creating a user account (“Account”), you consent to receive marketing, advertisements, special promotions, news, mail, emails, text messages, phone calls and new product information from Tri-Loop or its third-party agents or affiliates.

3. Receipt and Collection of Information. We receive and/or collect information from you in the following ways:

3.A. General Access to the Tri-Loop Website. Tri-Loop does not currently require you to provide Personal Information in order to visit and review the general information available on the Website.

3.B. You Submit Information to Tri-Loop. You submit Personal Information to Tri-Loop by emailing or calling us directly, or submitting a quote request directly through the Website.

3.C. Account Creation. In order to use and access certain portions of the Tri-Loop Website, you will be required to create an account (“Account”) and provide us with information such as your name, email address, password and other specified information that you will use to create an account profile. You may also use your Account to store credit card and other purchase information and shipping addresses. You are able to login to your Account at any time and edit your Personal Information and settings. It is your responsibility to keep your password confidential. If you are sharing a computer with anyone you should always logout before leaving the Tri-Loop Website to protect access to your information from subsequent users.

3.D. Purchases. If you choose to purchase a service or product from Tri-Loop we will require sufficient information from you to complete the transaction. Such information could include a credit card number and related account and billing information, invoice related information, and other data required to process the order. We may use the tools, software or services of third-party service providers to process transactions on our behalf (but we require that these parties agree to comply with this Privacy Policy). All information of this nature is maintained by us in a secure database and transmitted across the Internet from you to us using secured transmission encryption. Except as set forth herein, we will not share your financial Personal Information with any third person or entity.

3.E. Cookies and Other Tracking Technologies. Some of the Tri-Loop Website pages utilize "cookies" and other tracking technologies. A "cookie" is a small file that may be used, for example, to collect information about the Tri-Loop Website activity. Some cookies and other technologies may serve to recall Personal Information previously indicated by a Tri-Loop Website user. You may block cookies, or delete existing cookies, by adjusting the appropriate setting on your browser. Please consult the HELP menu of your browser to learn how to do this. 3.F. Log Files. Like many other websites, the Tri-Loop Website may make use of log files. The information inside the log files includes the IP address from which you access the Tri-Loop Website, the type of browser and operating system you use to access the Tri-Loop Website, the date and time you access the Tri-Loop Website, the pages you visit, and the addresses of pages from where you followed a link to the Tri-Loop Website. We may use such information to analyze trends, administer the Tri-Loop Website, track users’ movement around the Tri-Loop Website, and gather demographic information. Such information is not linked to any information that is Personal Information, with the exception of the IP address which might be used to identify spamming attempts.

4. Publicly Available Information. Any information, video, image, data, text, documents, or other content posted at your direction onto a public area of the Tri-Loop Website becomes publicly published content and will be available to all users of that public area of the Tri-Loop Website, even if such content contains Personal Information. If you publish your contact information, you may receive unsolicited messages from other users and visitors to the Tri-Loop Website. We encourage you to publish only information you are sure you want to be accessible to anyone.

5. Personal Information Uses. If you submit Personal Information to us through the Tri-Loop Website:

•   We generally expect to use your Personal Information to improve our services to you, to ensure accurate shipment and billing information, to contact you and to identify and authenticate your access to the Tri-Loop Website’s services that you are authorized to access.

•   We may transfer your Personal Information within Tri-Loop or to Tri-Loop's third-party service providers, but only to provide services on the Tri-Loop Website or to you. This information may be transferred to other countries around the world as a result. We may also provide Personal Information and non-personally-identifiable information to our subsidiaries, affiliated companies, or other businesses or persons for the purpose of processing such information on our behalf. •   We may use your email and other contact information for marketing and advertising by Tri-Loop.

•   We may disclose your Personal Information or any information you submitted via the Tri-Loop Website and its services if we have a good faith belief that disclosure of such information is helpful or reasonably necessary to (i) comply with any applicable law, regulation, legal process or governmental request, (ii) enforce our Terms of Use including investigations of potential violations thereof, (iii) detect, prevent, or otherwise address fraud or security issues, or (iv) protect against harm to the rights, property or safety of Tri-Loop, its users, yourself or the public.

•   We may use or disclose your Personal Information for other legal purposes that we in our sole discretion deem an appropriate to purpose, including but not limited to, enhance the Tri-Loop Website, enhance user experience, product development, marketing, advertising, analytics, etc.

6. Mobile Website & App Data Collection. If you access Tri-Loop’s Website via a mobile device or have downloaded our mobile app, we may also automatically collect information about the type of mobile device you use, your mobile device identifier, your mobile operating system, pages you visit on our mobile site, search terms, the type of mobile internet browsers you use and information about the way you use our the Website through a mobile device and app. We use this information to obtain data about your visits to our stores, your general shopping habits, how you use our mobile platforms and how we might improve them.

If you choose to share your location with us, we may use a service provider to approximate your position based on one or more of the following, as available: network location (cell tower triangulation) technology, GPS, wi-fi signals and/or Bluetooth signals. In addition, we may also send you push notifications based on your location if you activate your location settings on your device. IF YOU DO NOT WANT US TO HAVE ACCESS TO YOUR LOCATION, YOU MAY CHANGE YOUR LOCATION SETTINGS AS PERMITTED BY YOUR MOBILE DEVICE. TRI-LOOP HAS NO RESPONSIBILITY OR LIABILITY FOR THE FUNCTION OF THE LOCATION SETTINGS FEATURE WITHIN ANY MOBILE DEVICE.

Once you allow location based tracking through a mobile application or mobile website, you are agreeing that we can collect and use your location data and can continue to do so until you turn off your location settings and/or opt out of that usage, as may be permitted by your mobile device. We use this location based data to track your general shopping patterns and stores that you visit and we also aggregate this data to help understand general consumer patterns and trends.

7. Choice. You may choose whether or not to provide Personal Information to Tri-Loop. If you choose not to provide the Personal Information we request, you can still visit many parts of the Tri-Loop Website, but you may be unable to access certain options, offers, and services that involve our interaction with you, such as purchases.

You may opt-out from email advertisements or promotions, phone and mobile communications, and other forms of marketing from Tri-Loop. You may also request we cancel your Account at any time. To make any of these requests, contact: privacy@tri-loop.com.

8. Access/Accuracy. To the extent that you do provide us with Personal Information, Tri-Loop wishes to maintain accurate and complete Personal Information. If you have an Account, you may login to your personal profile at any time and add information, delete information or correct any incorrect information on file. The accuracy and completeness of any and all Personal Information, including, but, not limited to, ongoing updates and updates to shipping and billing information, is solely and exclusively your responsibility.

9. Collection of information by third-party sites. The Tri-Loop Website may use third-parties to present or serve advertisements that you may see at the Tri-Loop Website. These third-party ad servers may use cookies, web beacons, clear gifs or similar technologies to help present such advertisements, and to help measure and research the advertisements' effectiveness. The use of these technologies by these third-party ad servers is subject to their own privacy policies and is not covered by our Privacy Policy.

10. Links to Other Sites. The Tri-Loop Website contains links to other sites. Other sites may also reference or link to the Tri-Loop Website. Tri-loop is not responsible for the privacy practices or the content of such other sites.

11. Privacy for Minors. The Tri-Loop Website is not intended for or structured to attract children under the age of 18. Accordingly, Tri-Loop does not intend to collect Personal Information from anyone we know to be under 18 years of age.

12. Merger, Sale, or Bankruptcy. In the event that Tri-Loop is acquired by or merged with a third-party entity, we reserve the right to transfer or assign the information we have collected from our users as part of such merger, acquisition, sale, or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how your Personal Information is treated, transferred, or used. In any of the circumstances described in this paragraph, the information will be subject to the privacy policy of the purchaser or assignee.

13. Security. The security of your Personal Information is important to us. We do not sell, trade, or rent any of your personal information. Tri-Loop follows generally accepted industry standards to protect the Personal Information submitted to us, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security. 14. Commitment. Tri-loop is committed to protecting your privacy in accordance with applicable laws, industry custom, and our goal to provide a high-end user experience. Protecting your privacy online is an evolving area, and accordingly the Tri-Loop Website may from time-to-time evolve to meet these demands. Please note that opting out of promotional emails will not prevent you from receiving administrative communications, such as those concerning the operation of the Website or order information, or about a review, question, answer or comment you have submitted.

16. California Residents. Under California law, California residents have a right to prevent certain disclosures of personal information to third parties for their marketing purposes. Tri-Loop does not disclose information to third parties for their marketing purposes.
